An advanced Level 3 course for those who manage procurement, logistics, trade finance, commercial legal matters or projects and need to master the Incoterms® 2020 rules when the stakes are high. An in-depth study, with real cases decided by courts in the United Kingdom and the United States and documented maritime events: the relationship between risk, ownership and payment; documentary credits subject to UCP 600 and the consistency of the documents with the rule; cargo insurance under the Institute Cargo Clauses and general average; logistics disruption, demurrage and congestion; project cargo, heavy cargo and Oil & Gas, including logistics bases and offshore delivery points; building claims, time limits and evidence; and drafting complete delivery clauses, with an integrating case. It includes Excel exercises with model answers and illustrative clause templates. Prerequisite: PSC-213 (Incoterms® 2020 in Practice) or equivalent experience. The course explains the ICC rules in its own words and does not replace the official publication or legal advice. The course is delivered in Portuguese.

What you will learn

• Distinguish, and align in the contract, the passing of risk, the transfer of ownership and the timing of payment.
• Align the Incoterms® rule, the documents and the documentary credit to avoid discrepancies.
• Assess the insurance cover appropriate to the chosen rule and manage claims and general average.
• Allocate in the contract the costs and risks of delays, congestion, deviations and demurrage that the rules do not resolve.
• Choose and draft the rule and place of delivery for project cargo, heavy cargo and Oil & Gas supplies.
• Build and defend a claim relating to delivery, risk or documents, meeting time limits and evidence requirements.
• Draft complete delivery clauses and apply them in an end-to-end integrating case.
